Terms of Service

1. Introduction
Welcome to LINGUA LAW LLC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, www.lexpertis.me (the "Website"), and our expert coordination services. By accessing or using our services, you agree to be bound by these Terms.
2. Description of Services
We provide the following services:
-        Search and selection of an expert (country expert, psychological expert, or other specialists)
-        Coordination and communication between the expert and the client
-        Consulting the client on the expert’s requirements for documents necessary to conduct an evaluation and prepare a report.
-        Assistance in collecting, reviewing, and organizing such documents for completeness and relevance to the expert's needs.
Note: LINGUA LAW LLC does not provide expert services and is not an expert organization. Experts are not our employees or affiliates; they act independently.

The client pays our organization to find an expert, to advise about the expert's requirements, and to review the documents to be submitted to the expert for the earliest possible review.
What exactly is the value that our organization provides:
-        We will save the client dozens of hours in finding an expert who can analyze the client's situation and provide a competent opinion that will be accepted by the immigration court.
-        we will save the client many hours of pre-preparation, pre-communication and sending documents to the expert.
-        we will analyze the client's documents and tell the client what documents are missing for a full expert opinion.
-        we will provide an interpreting service between the client and the expert, if necessary (our service includes 4 hours of interpreter's work).

3. No Legal Advice Disclaimer
All services are provided strictly for informational purposes. We do not provide legal advice, representation, or services. We are not a law firm. Clients must seek licensed legal counsel for any legal matters.

4. Payment and Refund Policy
-        Clients must prepay 50% of the total fee for each expert report.
-        $100 of this advance payment is a non-refundable deposit under all circumstances.
-        Late payments over 15 days incur a penalty of 0.03% per day on the outstanding balance.
-        The remaining balance is due within 3 days after the client is notified that the final expert report is ready.
-        We work with experts, some of whom do not charge for their work or peer review. This does not affect the cost of our services to the client and does not affect the amount of payment.
-        Our fee may include the cost of paying for the expert's time.
-        We do not disclose the cost we pay to the expert for the time he or she spends reviewing client documents and preparing his or her opinion. The client has no right to require us to disclose this information.
-        We do not guarantee the content or conclusions of any expert report. Experts act independently and may issue conclusions that are unfavorable to the client.

5. Limitation of Liability
To the maximum extent permitted by law, LINGUA LAW LLC, its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business interruption. Our total liability under any theory of law shall not exceed the amount paid by the client for the specific service giving rise to the claim.

6. Client Responsibilities
By using our services, you:
-        Confirm that you are legally authorized to provide all submitted documents for expert review.
-        Acknowledge that low quality, unreadable, or altered documents may affect the accuracy or outcome of the expert’s opinion.
-        Agree to review the draft expert report and notify us of any errors or issues within 48 hours of delivery.
-        Accept the draft report as final if no errors are reported within the 48-hour period.
-        You agree that the payment is final, whether or not the expert charges some fee for their time.
-        Acknowledge that you are responsible for reviewing all reports and documents before sharing them with any third parties, including government or legal authorities.
-        Confirm that you are aware and agree that we may pay the expert for his time out of the amount paid by you (client) to us, based on the expert's hourly rate or flat rate, but are not obliged to do so if the expert does not charge for his time.
-        Confirm that you are aware of and agree that if the expert performs his/her work pro-bono and does not charge for his/her time, this is not a basis for a recalculation or refund to the client from our company.

7. Acceptance of Reports and Dispute Resolution
Clients have 48 hours to review the final unsigned draft of the expert report and report any concerns. If no issues are raised within this timeframe, the report is deemed accepted. No further edits or disputes will be considered after acceptance.

8. No Guarantee of Acceptance
While our expert reports are generally accepted by immigration courts and agencies, we do not guarantee acceptance by any particular court, agency, or institution. It is the client’s responsibility to confirm requirements before submission.

9. Intellectual Property
All expert reports remain the intellectual property of the respective expert. Clients are granted a limited, non-exclusive license to use the report for their personal immigration matters only. Any publication or distribution of the report or excerpts thereof without prior written permission is a copyright violation and subject to a penalty of $100,000.
10. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of law’s provisions.
Any disputes shall be resolved exclusively by binding arbitration in Spokane, Washington, in accordance with the rules of the American Arbitration Association (AAA).

11. Amendments
We reserve the right to modify these Terms at any time. Updated versions will be posted on our Website and are effective upon posting.
